 (CNS) - An Anaheim police officer was justified when he  fatally shot a 25-year-old man last July, Orange County District Attorney Tony  Rackauckas announced today.

Officer Nick Bennallack fatally shot Manuel Diaz July 21 in the 600  block of North Anna Drive. Diaz's family has filed a $50 million wrongful death  lawsuit against the officer and city.

Police said Diaz and his two companions ran when they were approached by  officers. Police also claimed Diaz was a documented gang member from Santa  Ana, an allegation his family has denied.
